The Site is operated by Sharrock Pitman Legal Pty Ltd trading as LegalRocket (ABN 50 163 550 767 the “Law Practice”). The Liability of the Law Practice is limited by a scheme approved under Professional Standards Legislation.

By using the Site and any information, services or documents available on the Site you (“the User” or “Users”) agree to our Terms and Conditions set out below.

DISCLAIMER FOR FREE DOCUMENTS AND INFORMATION

  • Documents and information which are provided free of charge by the Law Practice are provided without any specific and professional legal advice and assistance having been given.
  • As such, the document and/or information is for general purposes only, has not been customised to any specific circumstances and is used at the User’s own absolute risk.
  • Users must only use and complete a document in accordance with the instructions provided by the Law Practice on the Site.
  • The Law Practice makes no representations about the suitability of any free information or documents available on the Site for any purpose.
  • No liability will be incurred by the Law Practice to any person, business or other entity who relies upon any document or information available on the Site to their legal or financial detriment unless the Law Practice has been formally retained to provide professional legal advice and assistance for reward prior to reliance on the document or information.

INTELLECTUAL PROPERTY

  • All intellectual property in any information, documents, graphics, multimedia work or other material available on the Site shall remain the property of the Law Practice and may not be copied, reproduced, imitated, whether in whole or in part, unless expressly permitted in writing by the Law Practice.

USE OF THE SITE AND DOCUMENTS

  • Users of the Site are permitted to use the information and documents available on the Site for their own personal or business use in accordance with these Terms.
  • Users of the site are not permitted:-
    • To reproduce, distribute, share, licence, modify or re-sell the information, documents or other material available on the Site or issued to the User by the Law Practice, whether or not for commercial gain.
    • To remove the LegalRocket logo, liability limitation and copyright statement from a document;
    • To use the information, documents or other material available on the Site for any illegal purpose.
  • The Site is used at the risk of the User.
  • The Law Practice may make changes or improvements and/or update the information or documents on the Site at any time.
  • Users acknowledge that the Site may use and store cookies on your web browser. However Users may disable the use of cookies through your web browser at any time.
  • Users must not attempt to interfere, change, deface, hack, remove, add or make any changes to the Site, or engage in any illegal activities through the Site.
  • Users must not use the Site in a manner that defames, harasses, unlawfully offends or harms any person.
  • Any reference on the Site to any other company or business or to their services or products is not an endorsement by the Law Practice nor should it imply any such endorsement of the quality or fitness for purpose of that company or business or of their services or products.
  • Any links in the Site will allow you to leave the Site. The linked sites are not under the control of the Law Practice and the Law Practice is not responsible for the content of any linked site or any link contained in a linked site or any changes or updates to such sites.

WARRANTY BY USERS

  • Users warrant as follows:-
    • They are authorised to act for the individual, company or other enterprise upon whose behalf they use and access the Site;
    • They are authorised to act for the individual, company or other enterprise upon whose behalf they engage the Law Practice; and
    • The information that they provide to the Site and the Law Practice is accurate and current and that they are not infringing any Intellectual Property licences by provision of the information.

PAYMENT FOR SERVICES

  • Upon engaging the Law Practice to provide legal services via the Site:
    • If the fee for legal services will not exceed the sum of $750.00 exclusive of GST then the Law Practice will issue the User an invoice for payment prior to rendering of the legal service. Upon payment the Law Practice will complete the legal services in a timely manner and the Law Practice has the same additional obligations to the User as they would any client under the Legal Profession Uniform Law.
    • If the fee for legal services is to exceed the sum of $750.00 exclusive of GST then the Law Practice will provide the User with a Scoping of Legal Work and Costs Disclosure as required by the Legal Profession Uniform Law and the further terms and conditions contained in such Scoping and Costs Disclosure will operate in place of any terms and conditions contained herein.

SERVICE BY EMAIL

  • Users warrant that the email address provided by them to the Law Practice is a valid email address which is sufficiently secure, reliable and otherwise suitable for the receipt of legal documents and correspondence.
  • All Tax Invoices, correspondence and notices from the Law Practice will be forwarded to the email address provided by the User and no liability will be incurred by the Law Practice for any failure of a User to receive same.
  • While every effort has been made to ensure that the Site and all email or other correspondences are free from computer viruses and other malicious code, the Law Practice shall not be liable for any loss or damage to any computer hardware or software caused by any malicious or erroneous code infecting or affecting the Site or any email or other correspondence.

CHANGES TO THE TERMS

  • The Law Practice may amend or vary these Terms and Conditions at any time by publishing the amended Terms on the Site. Users agree and acknowledge that publication of varied Terms and Conditions is sufficient notice to you of any amendments.

CANCELLATION AND SUSPENSION

  • The Law Practice reserves the right to cancel or suspend any Users access to the Site.

APPLICABLE LAW

  • The applicable law relating to these Terms and Conditions and any dispute relating to the Site or Law Practice is the law of the State of Victoria and the Courts of the State of Victoria have jurisdiction for the resolution of any such dispute.
